ข้อกำหนดการใช้บริการ
ข้อกำหนดฉบับนี้ ("ข้อกำหนด") เป็นข้อตกลงระหว่างคุณกับ PromptAds ("เรา") ว่าด้วยการใช้บริการ PromptAds — ระบบผู้ช่วย AI สำหรับสร้างและจัดการแคมเปญโฆษณาบนแพลตฟอร์ม Meta ผ่านการสนทนาภาษาธรรมชาติ การสมัครใช้งานหรือใช้บริการถือว่าคุณยอมรับข้อกำหนดฉบับนี้ทั้งหมด
01คำอธิบายบริการ
PromptAds ช่วยคุณสร้าง จัดการ และติดตามแคมเปญโฆษณาในบัญชีโฆษณา Meta ของคุณเอง ผ่านการสนทนา โดยมีหลักการทำงานสำคัญคือ
- ทุกการดำเนินการที่เขียนข้อมูลไปยังบัญชีโฆษณาของคุณ (สร้างแคมเปญ ปรับงบประมาณ หยุดโฆษณา ฯลฯ) ต้องได้รับการอนุมัติจากคุณก่อนทุกครั้ง ระบบจะไม่ดำเนินการใด ๆ โดยอัตโนมัติหากไม่ได้รับคำยืนยัน
- ระบบจัดทำรายงานประสิทธิภาพและข้อเสนอแนะการปรับปรุงแคมเปญ ซึ่งเป็นข้อมูลประกอบการตัดสินใจ — การตัดสินใจขั้นสุดท้ายเป็นของคุณเสมอ
02บัญชีผู้ใช้และคุณสมบัติ
- คุณต้องมีอายุอย่างน้อย 20 ปีบริบูรณ์ หรือเป็นนิติบุคคลที่จดทะเบียนถูกต้อง และมีความสามารถตามกฎหมายในการทำสัญญา
- คุณต้องเป็นเจ้าของหรือได้รับอนุญาตโดยชอบให้จัดการบัญชีโฆษณา Meta และเพจ Facebook ที่นำมาเชื่อมต่อกับบริการ
- คุณรับผิดชอบในการรักษาความปลอดภัยของบัญชีผู้ใช้และข้อมูลเข้าสู่ระบบของคุณ
03ความสัมพันธ์กับแพลตฟอร์ม Meta
PromptAds เป็นบริการอิสระ ไม่ได้เป็นบริษัทในเครือ ไม่ได้รับการรับรอง และไม่ได้เป็นตัวแทนของ Meta Platforms, Inc. การใช้บริการของเราไม่ได้ยกเว้นคุณจากข้อผูกพันที่มีต่อ Meta — คุณยังคงต้องปฏิบัติตาม
- ข้อกำหนดการใช้งานของ Meta และนโยบายการโฆษณา (Meta Advertising Standards)
- เงื่อนไขของบัญชีโฆษณาและวิธีการชำระเงินที่คุณตั้งค่าไว้กับ Meta โดยตรง
Meta อาจปฏิเสธโฆษณา จำกัดบัญชี หรือเปลี่ยนแปลงนโยบายและ API ได้ตลอดเวลาตามดุลยพินิจของ Meta ซึ่งอยู่นอกเหนือการควบคุมของเรา
04ค่าโฆษณาและงบประมาณ
- งบประมาณทุกรายการที่ระบบตั้งค่าให้ จะแสดงให้คุณตรวจสอบและอนุมัติก่อนมีผลเสมอ
- ระบบมีกลไกตรวจสอบงบประมาณหลายชั้นเพื่อช่วยป้องกันความผิดพลาด แต่คุณเป็นผู้รับผิดชอบต่อค่าใช้จ่ายที่เกิดจากการดำเนินการที่คุณอนุมัติแล้ว
05แพ็กเกจและการชำระเงิน
- บริการมีทั้งแพ็กเกจฟรีและแบบสมัครสมาชิกรายเดือน รายละเอียดและราคาปัจจุบันแสดงบนเว็บไซต์ของเรา
- ค่าสมาชิกเรียกเก็บล่วงหน้าเป็นรายรอบ และไม่คืนเงินตามสัดส่วนสำหรับรอบที่เริ่มไปแล้ว เว้นแต่กฎหมายกำหนดไว้เป็นอย่างอื่น
- คุณยกเลิกการสมัครได้ตลอดเวลา โดยมีผลเมื่อสิ้นสุดรอบการเรียกเก็บปัจจุบัน
- เราอาจปรับราคาได้ โดยจะแจ้งล่วงหน้าอย่างน้อย 30 วันก่อนมีผลกับรอบถัดไป
06ความรับผิดชอบของผู้ใช้
คุณตกลงว่า
- เนื้อหาโฆษณาที่คุณจัดเตรียมหรืออนุมัติ (ข้อความ รูปภาพ ลิงก์ปลายทาง) ต้องถูกต้องตามกฎหมายไทยและกฎหมายที่เกี่ยวข้อง รวมถึงกฎหมายคุ้มครองผู้บริโภค และไม่ละเมิดสิทธิของบุคคลอื่น
- ข้อมูลธุรกิจและสินค้าที่ให้กับระบบเป็นความจริง ไม่ทำให้เข้าใจผิด
- จะไม่ใช้บริการเพื่อวัตถุประสงค์ที่ผิดกฎหมาย หลอกลวง หรือละเมิดนโยบายของ Meta
- จะไม่พยายามแทรกแซง ทำวิศวกรรมย้อนกลับ หรือใช้งานระบบในทางที่ผิด
07ข้อจำกัดของระบบ AI
- บริการใช้โมเดลภาษาขนาดใหญ่ (LLM) ในการตีความคำสั่งและสร้างคำอธิบาย ซึ่งอาจมีความคลาดเคลื่อนได้ — ระบบจึงออกแบบให้คุณตรวจสอบและอนุมัติก่อนทุกการดำเนินการสำคัญ
- รายงานและข้อเสนอแนะของระบบเป็นข้อมูลประกอบการตัดสินใจ ไม่ใช่การรับประกันผลลัพธ์ทางโฆษณาหรือทางธุรกิจ ผลของแคมเปญขึ้นกับปัจจัยหลายอย่างที่อยู่นอกการควบคุมของเรา เช่น ระบบประมูลของ Meta พฤติกรรมผู้ชม และคุณภาพชิ้นงานโฆษณา
08ทรัพย์สินทางปัญญา
- ซอฟต์แวร์ ระบบ และเครื่องหมายของ PromptAds เป็นทรัพย์สินของเรา คุณได้รับสิทธิใช้งานแบบจำกัด เพิกถอนได้ และโอนไม่ได้ เพื่อใช้บริการตามข้อกำหนดนี้เท่านั้น
- เนื้อหาโฆษณา ข้อมูลธุรกิจ และข้อมูลแคมเปญของคุณยังเป็นของคุณ — คุณให้สิทธิเราใช้ข้อมูลดังกล่าวเท่าที่จำเป็นต่อการให้บริการแก่คุณ ตามนโยบายความเป็นส่วนตัว
09ข้อจำกัดความรับผิด
ตามขอบเขตสูงสุดที่กฎหมายอนุญาต
- บริการให้ "ตามสภาพ" (as is) เราไม่รับประกันว่าบริการจะปราศจากข้อผิดพลาดหรือไม่หยุดชะงัก
- เราไม่รับผิดต่อความเสียหายทางอ้อม ความเสียหายพิเศษ หรือการสูญเสียกำไร รวมถึงความเสียหายจากการที่ Meta ปฏิเสธโฆษณา จำกัดหรือระงับบัญชี เปลี่ยนแปลงนโยบายหรือ API
- ความรับผิดรวมสูงสุดของเราจำกัดไม่เกินค่าบริการที่คุณชำระให้เราในช่วง 12 เดือนก่อนเหตุแห่งความรับผิด
ข้อจำกัดข้างต้นไม่ตัดสิทธิที่คุณมีตามกฎหมายคุ้มครองผู้บริโภคซึ่งไม่อาจสละได้
10การระงับและการยกเลิก
- คุณยกเลิกบัญชีและเพิกถอนการเชื่อมต่อ Meta ได้ตลอดเวลา — ดูขั้นตอนการลบข้อมูลที่หน้าการลบข้อมูลผู้ใช้
- เราอาจระงับหรือยุติการให้บริการแก่บัญชีที่ละเมิดข้อกำหนดนี้ ใช้บริการโดยผิดกฎหมาย หรือก่อความเสี่ยงต่อระบบหรือผู้ใช้รายอื่น โดยจะแจ้งให้ทราบเว้นแต่มีเหตุจำเป็นเร่งด่วน
11กฎหมายที่ใช้บังคับ
ข้อกำหนดนี้อยู่ภายใต้บังคับของกฎหมายไทย ข้อพิพาทที่เกิดขึ้นให้อยู่ในเขตอำนาจของศาลไทย
12การเปลี่ยนแปลงข้อกำหนด
เราอาจปรับปรุงข้อกำหนดนี้เป็นครั้งคราว หากมีการเปลี่ยนแปลงอย่างมีนัยสำคัญ เราจะแจ้งผ่านระบบหรืออีเมลล่วงหน้าก่อนมีผลบังคับใช้ การใช้บริการต่อหลังวันที่มีผลถือว่ายอมรับข้อกำหนดฉบับใหม่

Terms of Service
These Terms of Service ("Terms") are an agreement between you and PromptAds ("we", "us") governing your use of PromptAds — an AI assistant for creating and managing advertising campaigns on Meta platforms through natural-language conversation. By signing up for or using the service, you accept these Terms in full.
01The service
PromptAds helps you create, manage, and monitor ad campaigns in your own Meta ad account through conversation. Two operating principles apply throughout:
- Every action that writes to your ad account (creating campaigns, adjusting budgets, pausing ads, and so on) requires your explicit approval first. The system takes no automated action without your confirmation.
- Performance reports and optimization proposals produced by the system are decision-support information — the final decision is always yours.
02Accounts and eligibility
- You must be at least 20 years of age, or a duly registered legal entity, with legal capacity to enter into contracts
- You must own, or be properly authorized to manage, the Meta ad account and Facebook Pages you connect to the service
- You are responsible for keeping your account credentials secure
03Relationship with Meta platforms
PromptAds is an independent service. We are not affiliated with, endorsed by, or an agent of Meta Platforms, Inc. Using our service does not relieve you of your obligations to Meta — you remain bound by:
- Meta's Terms of Service and Advertising Standards
- The terms of the ad account and payment method you have set up directly with Meta
Meta may reject ads, restrict accounts, or change its policies and APIs at any time at its own discretion — these matters are outside our control.
04Ad spend and budgets
- Every budget the system configures is shown to you for review and approval before it takes effect
- The system includes multiple budget-validation safeguards to help prevent errors, but you are responsible for spend resulting from actions you have approved
05Subscription and billing
- The service offers a free tier and paid monthly subscriptions; current plans and pricing are shown on our website
- Subscription fees are billed in advance per billing cycle and are not refunded pro rata for a cycle already started, unless required by law
- You may cancel at any time; cancellation takes effect at the end of the current billing cycle
- We may change prices with at least 30 days' notice before the change applies to your next cycle
06Your responsibilities
You agree that:
- Advertising content you provide or approve (copy, images, destination links) must comply with Thai law and other applicable laws, including consumer-protection law, and must not infringe the rights of others
- Business and product information you give the system is truthful and not misleading
- You will not use the service for unlawful or deceptive purposes, or in violation of Meta's policies
- You will not interfere with, reverse-engineer, or misuse the service
07AI limitations
- The service uses large language models (LLMs) to interpret instructions and generate explanations. LLM output can be imperfect — which is why the system is designed so that you review and approve every consequential action
- Reports and proposals are decision-support information, not a guarantee of advertising or business results. Campaign outcomes depend on many factors outside our control, including Meta's auction system, audience behavior, and creative quality
08Intellectual property
- The PromptAds software, systems, and marks are our property. You receive a limited, revocable, non-transferable license to use the service under these Terms
- Your ad content, business information, and campaign data remain yours — you grant us a license to use them only as needed to provide the service to you, as described in our Privacy Policy
09Limitation of liability
To the maximum extent permitted by law:
- The service is provided "as is"; we do not warrant that it will be error-free or uninterrupted
- We are not liable for indirect, special, or consequential damages or lost profits, including damages arising from Meta rejecting ads, restricting or suspending accounts, or changing its policies or APIs
- Our total aggregate liability is capped at the fees you paid us in the 12 months preceding the event giving rise to liability
Nothing above limits rights you hold under consumer-protection law that cannot be waived.
10Suspension and termination
- You may close your account and revoke the Meta connection at any time — see the User Data Deletion page for the deletion process
- We may suspend or terminate accounts that violate these Terms, use the service unlawfully, or pose a risk to the system or other users, with notice unless urgent circumstances require otherwise
11Governing law
These Terms are governed by the laws of Thailand. Disputes are subject to the jurisdiction of the Thai courts.
12Changes to these Terms
We may update these Terms from time to time. For material changes, we will give notice through the service or by email before they take effect. Continued use after the effective date constitutes acceptance of the updated Terms.
